Terms of Use

1. Acceptance of Terms

By accessing or using Beatstorm ("the Platform", "we", "us"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the Platform. We reserve the right to update these terms at any time. Continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 16 years old to register. By creating an account you confirm that the information you provide is accurate, that you are legally permitted to use the Platform in your country of residence, and that you will keep your account credentials confidential.

3. User Accounts

You are responsible for all activity that occurs under your account. You may not share, sell, or transfer your account. We may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or otherwise harm the Platform or its users.

You may delete your account at any time via account settings. Upon deletion we will remove your personal data in accordance with our Privacy Policy.

4. Content and Intellectual Property

You retain full ownership of any music you upload ("User Content"). By uploading to Beatstorm you grant us a non-exclusive, royalty-free, worldwide licence to stream and display your User Content solely within the Platform for the purpose of battles, voting, and leaderboards.

You represent and warrant that: (a) you own or have the necessary rights to your User Content; (b) your User Content does not infringe any third-party intellectual property rights; (c) you have obtained all necessary licences for any samples, loops, or third-party elements included in your beat.

We do not claim any ownership of your music. The licence you grant us ends when you delete your content or your account, subject to reasonable archival and backup retention periods.

5. Prohibited Content

You may not upload content that:

• Infringes copyrights, trademarks, or other intellectual property rights
• Contains hate speech, discrimination, or content that incites violence
• Is defamatory, obscene, or harassing toward individuals
• Violates applicable laws or regulations
• Contains malware, spam, or deceptive content

We reserve the right to remove any content that violates these terms without prior notice.

6. Battles and Voting

Battle outcomes are determined solely by community votes. We do not guarantee any particular outcome or ranking. Attempting to manipulate votes through bots, fake accounts, coordinated voting campaigns, or any other fraudulent means is strictly prohibited and will result in immediate account termination.

Battle results are final once a battle closes. We reserve the right to void a battle result if we detect manipulation.

7. Platform Availability

We aim to keep Beatstorm available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications at any time. We are not liable for any losses resulting from service interruptions.

8. Disclaimers and Limitation of Liability

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by applicable law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including loss of data, revenue, or opportunities.

9. Governing Law

These Terms are governed by the laws of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Frankfurt am Main, Germany, unless mandatory consumer protection laws in your country of residence require otherwise.
